Swage Terms of Use (public beta)

Draft, not a legal opinion. Written from the review in

docs/legal/LEGAL-SCAN-2026-09-28.md, without a lawyer. The owner

decided 02.10.2026 not to bring in a lawyer (docs/DECISIONS.md,

"юрист не привлекается"). The open points below are decided by the

orchestrator instead: docs/legal/DECISIONS-LEGAL-2026-10-02.md.

1. What the service is

For useswage.com the service is provided by [OWNER: full name], a

sole proprietor (osek) registered in Israel, No.

Swage is a web service that converts geodata between formats: any

supported format into any other, including pairs within the same

family (CAD-to-CAD, GIS-to-GIS). You upload a file, choose the

output formats, the service reads the source file, writes the chosen

formats, and verifies the written result against the source.

Supported input and output formats are listed on the service page and

may change. The service never writes DWG: DWG is read-only

(docs/landing/PRODUCT-BRIEF.md, "Formats").

2. The beta is free, file limit

The service is currently a free public beta. There are no paid tiers

yet (docs/DECISIONS.md, 2026-09-15: long-term storage is planned as a

paid feature, but no paid tier exists). The donate button on the

result screen is not a payment: it is a voluntary link to

[OWNER: donate address], shown only when that address is

configured. The service itself never processes payments.

The limit per file is 300 MB (src/smartetl/ingest.py:148,

constant RESERVE_MB, and the request-body size check in

src/smartetl/intake.py:354-362). The service may also limit the

number of objects and concurrent jobs. The limits in force are shown

on the page before upload.

3. What happens to your file

• The source file is processed only to do the job you started.
• The result stays available for download for a stated period, then

is deleted together with derived files (the period is shown on the

job screen, the default is 24 hours, src/smartetl/store.py:1167,

ttl_hours).

• The service does not use your file for anything else: it does not

pass it to third parties and does not train models on it. Details:

docs/legal/PRIVACY-en.md.

• If reading your file fails and you send it to us for review with the

"Send for review" button, that is a separate, explicit action: the

file is then kept longer than usual, solely to study the failure,

and deleted once the cause is found.

4. Your data and your result

The file and the result are yours. The service claims no rights over

the content of an uploaded file or the conversion result.

Responsibility for the legality of a file's content (including

third-party personal data inside cadastral layers, labels, or

attributes) rests with you, see also section 6.

5. Acceptable use

You may upload files you are entitled to handle (your own, or with the

data owner's permission). You may not:

• upload files you are not entitled to process or disclose to third

parties (third-party intellectual property without permission, data

barred from disclosure by law or contract).

• probe the service with aggressive load or attack testing without

prior arrangement.

• attempt to bypass limits on file size, job count, or access to

another user's job by guessing its number.

6. Third-party personal data inside your files

CAD and GIS files sometimes carry third-party personal data: names in

drawing title blocks, parcel owners in cadastral layers, addresses. By

uploading such a file you confirm you are entitled to have it

processed as described in docs/legal/PRIVACY-en.md, and you remain

responsible to those third parties yourself. On request, for a

business customer whose files contain third-party personal data, the

operator will sign a separate, reasonable data-processing agreement.

Until then the general terms of this document and of

docs/legal/PRIVACY-en.md apply (decided 02.10.2026,

docs/legal/DECISIONS-LEGAL-2026-10-02.md, point 2).

7. Service "as is", limitation of liability

• The service is provided "as is". The loss forecast shown before

writing and the "Verified" seal are measured, stated properties of

the service (docs/landing/PRODUCT-BRIEF.md), not a guarantee that any

given file is free of errors.

• The limitation of liability applies to the extent allowed by

applicable consumer-protection law (for individual users in Russia,

the Russian Law "On Protection of Consumer Rights", for EU

consumers, the corresponding national rules). It does not override

mandatory consumer protections (decided 02.10.2026,

docs/legal/DECISIONS-LEGAL-2026-10-02.md, point 3).

• The service is not responsible for the content of user files or for

decisions made on the basis of a conversion result.

8. Changes to these terms

These terms may change as the service develops (for example, when

paid tiers appear). The date of the last change is shown at the top.

Changes material to free beta users are announced on the service page.
